A. General Terms and Conditions for Consumers
§ 1 General
1. Dönges GmbH & Co. KG – hereinafter referred to as “Provider” – offers consumers goods from various product ranges, such as tools and DIY supplies, via this online shop. A consumer, according to § 13 BGB, is any natural person who enters into a legal transaction for purposes that predominantly cannot be attributed to their commercial or independent professional activity.
2. The following provisions apply to all contracts between the Provider and customers acting as entrepreneurs which are concluded via this online shop accessible at https://shop.doenges-rs.de/.
§ 2 Details and Technical Steps Leading to the Conclusion of the Contract
The subject of the contract is the sale of goods by the Provider to consumers, see definitions above.
1. By listing an item in this online shop, the Provider invites the customer to submit a purchase offer (order) (“invitatio ad offerendum”). The customer may submit the binding offer to the Provider via e‑mail, fax, the online contact form, postal mail, or telephone.
1.1. The customer places the item(s) intended for purchase into the virtual shopping cart. Via the corresponding icon in the navigation bar, the customer can access this virtual “shopping cart” and make any desired changes or additions at any time. After clicking the “Checkout” button and entering their personal information as well as the selected payment and shipping method, all order details are displayed again on an order overview page.
1.2. If the customer uses an instant payment method such as PayPal, they are first redirected to the website of the selected payment service provider, where they can continue the payment process. After the payment is completed, the customer is returned to the order overview page.
1.3. Before submitting the order, the customer may review and correct the entries in the order overview and may also cancel the order using the browser functions. By submitting the order via the corresponding button, the customer issues a binding purchase offer to the Provider. After submitting the order, the customer receives an automatic order confirmation stating that the Provider has received the binding purchase offer (order).
This order confirmation does not yet constitute a legally binding purchase contract between the customer and the Provider.
A binding purchase contract between the Provider and the customer is concluded only upon acceptance of the purchase offer through a corresponding e‑mail from the Provider confirming shipment of the goods, or through the direct dispatch of the ordered goods to the customer.
2. In the case of time‑limited special offers, the Provider is no longer bound by the offer if the customer chooses advance payment and fails to make payment to the Provider within 10 days from placing the order. The decisive factor is the receipt of payment by the Provider.
3. Notwithstanding § 2 No. 1.1 ff., the contract between the Provider and the customer is already concluded when the customer selects an instant payment method (e.g. PayPal) and completes the payment while submitting the order, after being redirected to the website of the selected payment service provider. After completing the payment, the customer is redirected to the order overview page.
In this case, the contract is concluded at the moment the customer initiates the payment and the payment service provider confirms execution of the payment instruction. If the customer does not receive a shipping or order confirmation within three business days after submitting their purchase offer, they are no longer bound by their order. Any payments already made will be refunded immediately.
§ 3 Right of Withdrawal
Consumers within the meaning of § 13 BGB are entitled to a statutory right of withdrawal. Details regarding the conditions, deadlines, and procedure for exercising the statutory right of withdrawal, as well as the model withdrawal form, can be found in the separately available withdrawal policy.
§ 4 Prices
1. All prices displayed within the offers are total prices and include the currently applicable statutory VAT.
2. Additional delivery and shipping costs may apply. Please refer to the respective offer for detailed information. If delivery is made outside the EU, additional customs duties, taxes, or fees may apply, which must be paid by the customer to the responsible customs or tax authorities, not to the Provider. Customers are advised to inquire about details from the respective authorities before placing an order.
§ 5 Payment Methods and Conditions
